1. Ownership of the website


INMOCEMENTO, S.A. (hereinafter referred to as the Enterprise), is the owner of the website (hereinafter, the Site). Its registered office is located at C/ Balmes 36 - 08007, Barcelona, and its tax identification number is A16367328.

The Enterprise is listed on the Barcelona Companies Register.

The domain name(s) through which you have accessed the Site is (are) owned by the Enterprise.

Said domain name(s) may not be used in connection with other content, products or services not owned by the Enterprise or in any manner that is likely to cause confusion among end users or bring the Enterprise into disrepute.

2. Purpose

This Legal Notice contains the terms and conditions of use that regulate access, browsing and use of the Site.

Merely accessing to the Site, sending requests for information, queries and, in general, any action of a similar nature to the above carried out using the form and electronic mailbox, if enabled, on the Site will mean your unreserved acceptance of each and every one of the rules included in this Legal Notice and in the Privacy Policy, and you shall hence be considered a User of the Site. Consequently, you should carefully read and understand the contents of this Legal Notice, as well as the Privacy Policy and the Cookie Policy.

3. Access and use of the Site

Access to the Site by Users is free of charge.

Merely accessing the Site does not in itself mean that any type of commercial link or relationship between the Enterprise and the User has been established, unless the appropriate means have been used for this purpose and the User has previously met any requirements that may be indicated.
In any case, the User is solely and exclusively responsible for accessing, browsing and using the Site, and therefore undertakes to diligently and faithfully follow any additional instructions given by the Enterprise or its authorised personnel regarding use of the Site and its contents.

Consequently, the User undertakes to use the contents in a diligent, correct and lawful manner, in accordance with the law in force and, more particularly, undertakes to refrain from
(i) Using them for purposes or with effects contrary to the law, morality, good customs or generally accepted public order and to the instructions received from the Enterprise.
(ii) Using them for purposes that are detrimental to the legitimate rights of third parties.
(iii) Using the contents and, in particular, information of any kind obtained through the Site or the services to send advertising, communications for the purposes of direct sales or any other commercial purpose, unsolicited messages addressed to several
persons for whatever purpose, and to refrain from marketing or otherwise disclosing such information.

4. Liabilities and limitations

The Enterprise cannot guarantee the reliability, usefulness or veracity of the information provided through the Site.

Accordingly, the Enterprises do not guarantee and shall not be held liable for:
       (i) The continuity of the contents of the Site and/or the lack of availability of or accessibility to the Site or technical continuity thereof;     
      (ii) The absence of errors in such contents or products;     
      (iii) The absence of viruses and other harmful components in the Site or in the server providing it;   
      (iv) The invulnerability of the Site and/or the impregnability of the security measures adopted therein;     
      (v) Where applicable, the lack of usefulness or performance of the contents or services of the Site; 
    (vi) Damage or harm caused, to themselves or to a third party, by anyone who infringes the conditions, rules and instructions established by the Enterprises on the Site or by violating the security systems thereof;
      (vii) Any other damage that may be caused due to reasons inherent to the non-functioning or defective functioning of the Site or of the websites to which, where applicable, links may have been established.
Nevertheless, the Enterprise declares that it has taken all necessary measures, within its possibilities and the state of technology, to guarantee the functioning of the Site and to avoid the existence and transmission of viruses and other harmful components to Users.

The Enterprise makes every effort to avoid errors in the contents published on the Site. All contents offered through the Site are updated, and the Enterprise reserves the right to modify them at any time. The Enterprise is not liable for any consequences that may arise from errors in the contents that may appear on the Site provided by third parties.
 
5. Intellectual and Industrial Property Rights

The Enterprise is the owner or has obtained the corresponding licence for the user rights regarding intellectual, industrial and image property on the contents available through it, including but not limited to texts, graphic designs, drawings, codes, software, photographs, videos, sound, databases, indexes, images, brands, logos, expressions and information and, in general, any other creation protected by national regulations and international treaties on intellectual and industrial property (hereinafter referred to jointly as the Contents).

All intellectual and industrial property rights on the Contents are reserved and, more particularly, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute in any way all or part of the Contents included on the Site for
public or commercial purposes without the prior, express and written authorisation of the Enterprise or, where applicable, of the holder of the corresponding rights.

Under no circumstances shall the User's access to and browsing of the Site be understood as a waiver, transmission, licence or total or partial transfer of the aforementioned rights by the Enterprise.

Consequently, it is forbidden to remove, evade or manipulate the copyright notice and any other data identifying the rights of the Enterprise or its owners included in the Contents, and the technical protection devices or any information and/or identification mechanisms that may be contained therein.

References to names and commercial or registered trademarks, logos or other distinctive signs, whether owned by the Enterprise or by third parties, involve a prohibition on their use without the consent of the Enterprise or their legitimate owners. At no time, unless expressly stated otherwise, does access to or use of the Site and/or its Contents confer any rights to the user regarding the trademarks, logos and/or distinctive signs included therein that are protected by law.

6. Links
6.1 Links from the Site to other websites

The Enterprise may provide links, directly or indirectly, to Internet resources or websites outside the Site. The presence of these links on the Site is for information purposes only and in no case constitutes an invitation to contract products and/or services that are offered or may be offered on the target websites nor does it imply the existence of any commercial link or relationship or dependence with the enterprise that owns the linked website. In these cases, the Enterprise shall not be responsible for establishing the general and particular terms and conditions to be taken into account in the use and provision of these services by third parties and, therefore, cannot be held liable for them.

The Enterprise has neither the power nor the human or technical means to know, control or approve all the information, contents, products or services provided by other websites to which links may be established from the Site. Consequently, the Enterprises may not assume any type of liability for any aspect relating to the website to which a link may be established from the Site, specifically but not limited to its operation, access, data, information, files, quality and reliability of its products and services, its own links and/or any of its contents, in general.

However, where the Enterprise becomes aware that the activity or information to which the links refer is illicit, constitutes a crime or could damage the property or rights of a third party, it will act with the necessary diligence to remove or disable the corresponding link as soon as possible.

Likewise, if Users have actual knowledge of the unlawfulness of activities carried out through these third-party websites, they must immediately notify each Enterprise so that it can proceed to disable the access link to the same.

6.2 Links from other websites to the Site

If any User, enterprise or website wishes to establish any type of link to the Site, it must follow the stipulations below:
     (i) Prior express written authorisation must be obtained from each Enterprise.
     (ii) The link may only lead to the home page of the Site, unless expressly authorised otherwise.
     (iii) The link must be absolute and complete, i.e. it must take the User, by way of one click, to the home page and must cover the entire screen of the Site's home page. Under no circumstances, unless otherwise authorised by the Enterprises, may the website from which the link is made reproduce the Site in any way, include it as part of its website or within one of its frames or create a browser on any of the pages of the Site.
      (iv) The website from which the link is established may not state in any way that the Enterprise concerned has authorised the link, without this having been the case. If the Enterprise that makes the link from its site to the Site correctly wishes to include the brand, name, trade name, label, logo or any other identifying sign of the Enterprise and/or the Site on its website, it must first have the prior, express and written authorisation of the Enterprise.
     (v) In any case, the Enterprises forbid the establishing of a link to the Site from those websites that contain materials, information or contents that are illicit, illegal, degrading, obscene and, in general, that contravene morality, public order, current legislation, generally accepted social norms or that are harmful to the legitimate rights of third parties.

7. Privacy policy

Please refer to the Site's "Privacy Policy" for information on the processing of personal data by the Enterprise, which is accessible from the "PRIVACY POLICY" button located at the bottom of the Site.

8. Cookies

9. Term and amendment

The Enterprise reserves the right to amend this Legal Notice and/or the particular terms and conditions that, where appropriate, have been established for use of the services provided through the Site when it deems appropriate or in order to adapt to legislative and technological changes, which shall become valid and take effect from the time of publication on the Site.

The temporary validity of these terms and conditions of use therefore coincides with the time they are displayed until they are totally or partially amended, at which time the amended terms and conditions of use will come into force.

The Entities may terminate, suspend or interrupt, at any time without prior notice, access to the contents of the website, without the User being able to claim any compensation whatsoever. After such termination, the prohibitions on the use of the contents set out above in this Legal Notice shall remain in force.

10. General

The headings of the various clauses are for information purposes only and shall not affect, qualify or modify the interpreting of the Legal Notice.
In the event of any discrepancy between the provisions of this Legal Notice and the particular terms and conditions which, where applicable, may be established with regard to the products or services offered on the Site, the provisions of the particular terms and conditions shall prevail.

Where any provision or provisions of this Legal Notice are deemed null and void or unenforceable, either in whole or in part, by any Court, Tribunal or competent administrative body, such nullity or unenforceability shall not affect the other provisions of the Legal Notice or any special terms and conditions that may have been established, as the case may be.

Failure by the Enterprises to exercise or enforce any right or provision contained in this Legal Notice shall not constitute a waiver thereof, unless acknowledged and agreed to in writing by the Enterprises.

11. Applicable law and competent courts

This Legal Notice and the relationships established between the Enterprise and the User, particularly the knowledge and resolution of any disputes, discrepancies or differences that may arise, shall be governed and resolved in accordance with the provisions of Spanish regulations regarding the applicable law and competent jurisdiction.

However, for cases in which the regulations foresee the possibility of the parties submitting to a jurisdiction, the Enterprise and the User, expressly waiving any other local law that may correspond, shall submit any controversy and/or litigation to the Courts and Tribunals of the city of Barcelona.
